These are all very good
questions.
First, you have the right to
file a claim for the damages that were caused by the fault of the other
driver. However, in Arizona, you don’t sue the other driver’s insurance
company.
You sue the one who is at fault for causing the damage—the
driver.
Once you have done this, his/her
insurance company will pay for the attorney and pay any award or judgment you
eventually receive.
It will be your burden to prove your damages and the
amount. If you can do that, you will be entitled to receive payment from
the other driver’s insurance company for your losses.
